Rep. Crank Votes to Safeguard U.S. Elections

WASHINGTON -- Today, Rep. Jeff Crank (CO-05) voted in favor of the Safeguard American Voters Eligibility (SAVE) Act, which passed the U.S House of Representatives. 

 

The SAVE Act will require an individual to provide proof of citizenship when registering to vote in federal elections and provide states with access to existing federal databases so they can clean up their voter registration rolls and remove noncitizens. 

 

"American elections should be reserved for American citizens only," said Rep. Jeff Crank. "The SAVE Act will require our election officials to certify one's citizenship prior to providing a voter registration form. It will also require that States review their voter rolls to remove noncitizens from being able to vote in the future. This should not be a one-sided issue, and Democrats continue to push for illegal immigrants to have equal or more rights than our own citizens."

 

While only U.S. citizens can legally vote in Federal elections, the National Voter Registration Act (NVRA) effectively stops states from checking citizenship during registration, preventing the law from being enforced. The SAVE Act is needed to require states to verify US citizenship when registering individuals to vote in federal elections, give states the tools to remove non-citizens from their voter rolls, and penalize officials that register non-citizens.

 

Background:

  • In Colorado, an individual can register to vote in federal elections without supplying any unique, government-issued identification number to prove identity much less citizenship.

  • As of June 17, 2024, the Arizona Secretary of State’s (SOS) website contained the following statement relative to voter registration: “A person is not required to submit proof of citizenship with the voter registration form, but failure to do so means the person will only be eligible to vote in federal elections…."

 

  • There is evidence to show that noncitizens are illegally voting in U.S. elections, for example:
    • As of May 2023, Virginia Department of Elections officials have removed 1,481 registrations from its official voter rolls with a reported reason for removal due to “noncitizen status.” Of those noncitizens who were removed, 335 individuals (or 22.6%) had cast a ballot in Virginia elections over the prior four years. In total, these noncitizens cast 838 ballots.
    • In 2014, North Carolina conducted a study that found over 1,400 registered voters on its rolls appeared to be non-citizens. 

 

  • The SAVE Act does not remove any legally registered voter from registration.      

 

  • The SAVE Act does not prohibit married women - or anyone who has changed their name - from voting.
    • Under the SAVE Act, those individuals (i.e. most) who have updated their documentary proof of citizenship (which can include things like a REAL ID, passport, or government-issued identification with their place of birth), no action is needed, and they can register to vote.
